The terms governing the RA DELIVERY Ultra subscription: activation, benefits, payment, renewal, cancellation and subscriber rights.

Terms of the optional subscription for RA DELIVERY Customers

RA DELIVERY Ultra provides the benefits displayed before subscribing for eligible orders. The price, duration, area, minimum value and any exclusions are presented transparently in the Platform before the subscription is confirmed.

Public document prepared for use on the RA DELIVERY website and applications. Mandatory rights provided by law prevail over any contrary contractual provision.

1. Scope and definitions

1.1. These terms supplement the general RA DELIVERY Terms and Conditions and apply to the subscription named “RA DELIVERY Ultra” or “Ultra”. In the event of any difference, these terms prevail only with respect to the subscription.

1.2. “Ultra Benefit” means the discount, included delivery, reduced fee, exclusive offer or other advantage marked in the Platform as being available to an Ultra subscriber. Ultra does not turn RA DELIVERY into the seller of the Merchant's products.

2. Eligibility and activation

2.1. To subscribe, the Customer must be at least 18 years old, have an active account and an accepted payment method, and be located in an area where Ultra is offered.

2.2. The subscription starts upon confirmation of payment or upon activation of the trial period. The confirmation, the fee, the date of the next payment and the commercial conditions are displayed in the account and provided on a durable medium where the law so requires.

3. Ultra benefits

3.2. Ultra does not automatically include the service fee, the small-order fee, demand or weather surcharges, packaging, the SGR (deposit-return system) guarantee, tips, the price of the products or other costs that are not expressly marked as included.

  • included or reduced delivery for Merchants and orders marked Ultra;
  • offers, prices, credits or promotions reserved for subscribers;
  • additional advantages clearly described on the subscription page;
  • access to benefits only within the area, time interval and conditions displayed before the order.

4. Eligible orders

4.1. An order is eligible only if the Platform displays the Ultra benefit before the order is placed. Eligibility may depend on the Merchant, address, distance, minimum value, category, schedule, delivery method and operational availability.

4.2. Benefits do not apply retroactively, cannot be converted into cash and cannot be combined with other offers unless the Platform expressly indicates that they may be combined.

5. Fee and payment

5.1. The monthly, annual or other available-period fee is the one displayed before subscribing, with all taxes included. Payment is collected through the method selected in the account.

5.2. RA DELIVERY may pre-authorise the payment method. If a payment fails, the Operator may request that the method be updated, may retry the charge within a reasonable interval and may suspend the benefits until payment is made, without charging any amounts that were not communicated.

6. Automatic renewal

6.1. Where the offer indicates automatic renewal, the subscription renews for the same period on the date displayed in the account, and the fee is charged automatically. Before contracting, the Customer is clearly informed about the recurring nature of the subscription and how to cancel it.

6.2. A change of fee applies only to a future period, after adequate prior notice and with the Customer having the possibility to cancel before it takes effect.

7. Cancelling the subscription

7.1. The Customer may stop the renewal from the Ultra section of the account or through support. Cancellation takes effect at the end of the period already paid, and the benefits remain active until then, except in the case of termination for fraud or serious breach.

7.2. The cancellation deadline and the next payment date are displayed in the account. RA DELIVERY does not impose a cancellation channel that is more difficult than the one used for subscribing.

8. Right of withdrawal

8.1. The consumer may benefit from the legal right of withdrawal within 14 days, under the conditions of OUG no. 34/2014 (Government Emergency Ordinance on consumer rights). The request is sent to [email protected] by way of an unequivocal statement.

8.2. If the Customer requests immediate activation and uses the benefits before the deadline expires, RA DELIVERY may retain only the proportional amount permitted by law for the service actually provided. Mandatory rights remain unaffected.

9. Trial periods

9.1. A trial period exists only if it is offered in the account. The duration, the eligibility, the date on which it converts into a paid subscription and the subsequent fee are displayed before activation.

9.2. A person or household may benefit from a single trial for the same offer, unless communicated otherwise. Creating multiple accounts in order to repeat the trial constitutes abuse.

10. Promotions and plans

10.1. RA DELIVERY may offer individual plans, plans for organisations, promotional plans or plans funded together with partners. The specific conditions displayed for the offer supplement this document.

10.2. Promotional credits, codes and benefits are personal, limited in time and subject to the criteria communicated. Their application must be checked in the order summary before confirmation.

11. Fair use

11.1. Ultra is intended for normal personal use. The following are prohibited: reselling the benefits, commercial sharing of the account, automation, false identities, simulated orders, exploiting errors and repeatedly obtaining trials or promotions without being eligible.

11.2. Anti-fraud measures are proportionate. Before a significant termination, the Customer receives the reasons and the possibility of a human review, except in the case of an immediate risk, a legal obligation or evident fraud.

12. Changes to benefits

12.1. The network of Merchants, the benefits and the area may evolve. Essential changes that reduce the value of the plan are communicated before they apply; the Customer may stop the renewal and may seek the remedies provided by law.

13. Suspension and termination

13.1. The subscription may be suspended for non-payment, account compromise, abuse or serious breach of the terms. The Operator limits the measure to what is necessary and allows it to be contested at [email protected].

13.2. RA DELIVERY may cease marketing Ultra. Subscribers are informed, and paid periods are honoured or refunded proportionally where provision of the service is no longer possible.

14. Refunds

14.1. The fee is not refunded for the mere non-use of the benefits. Refunds are granted where required by law, as well as those relating to an erroneous charge, a duplicate payment or a period during which the service could not be provided for reasons attributable to RA DELIVERY.

15. Data protection

15.1. Data regarding the subscription, payments, use of benefits, orders and interactions with support are processed for the performance of the contract, fraud prevention, compliance with legal obligations and service improvement, in accordance with the Privacy Policy.

16.2. Romanian law applies, without limiting the consumer's mandatory rights. Disputes may be resolved amicably, through the mechanisms of ANPC (the consumer protection authority) or by the competent courts.
